End User License Agreement

  1. THE PARTIES: This agreement is between the customer (meaning the parent/guardian) and ABC Educational Development, dba HI IQ Learning, (hereinafter referred to as HI IQ Learning). 

  2. TERM: The term commences on the date registered and paid for services and will terminate after the fulfillment 

  3. NOTICES: Anywhere in this Customer Enrollment Agreement: “Written notice” means (i) an email notice or (ii) a notice delivered via mail or by “Notice” means a “written notice” as defined above. 

  4. PAYMENT OPTIONS: Credit card/debit 

  5. GUARDIAN: A guardian must sign in/out their child upon drop-off and pick-up to ABC Educational Development, Inc. will not be responsible for any student once they have been signed out from camp. 

  6. CANCELLATION POLICY: The cancellation policy varies by program and is provided upon registration. For camps, should you choose to cancel your registration for any reason, you must provide notice 21 days before the start of the week you are enrolled in to receive a full refund minus a processing fee. There will be no refunds issued within 21 days of the start of the week you are enrolled in. In the event that a class has low enrollment, classes may be combined. For tutoring, all purchases of tutoring hours and packages are non-refundable once purchased.

  7. HEALTH AND WELLNESS AGREEMENT: All students and staff are required to stay home and not enter the learning center  if they are feeling sick or showing any symptoms of illness. This is a key step in keeping our center safe for everyone, and we kindly request for parents to assess their children before coming to our learning center.  Students with a positive flu test result or exhibit flu-like symptoms (including a fever of 100.0F or higher and body aches) without a negative test should refrain from attending the learning center for a period of 5 full days following the onset of symptoms. They may consider returning before the 5-day mark only if they have been free of fever for 24 hours without the use of fever-reducing medication and have received clearance from a doctor. In the case of a positive COVID test or the onset of COVID symptoms, students should also remain at home for 5 full days, counting from the day of the positive test or the start of symptoms, whichever comes first.

  8. PHOTO RELEASE: If parent/guardian agreed, HI IQ Learning permission to use their or their child’s photograph publicly to promote the They understand that the images may be used in print publications, online publications, presentations, websites, and social media. They also understand that no royalty, fees, or other compensation shall become payable to me by reason of such use. 

  9. NON-SUFFICIENT FUNDS (PAYMENTS): Unpaid invoices within 7 days will result in a cancellation of registration and the open spot be offered to another An NSF payment may result in the termination of this agreement at the sole discretion of HI IQ Learning. A replacement payment by cash, certified or cashier’s check or money order plus an NSF fee of Thirty-five dollars ($35) must be received by HI IQ Learning within five (5) business days after customer receives the NSF notification. Declined credit cards and stopped payments shall be considered as NSF payments. If a declined credit card is due to fraud protection service, no fee will be charged if the customer clears the card for payment within 3 days of notice of declined card. 

  10. TRANSFERABLE SERVICE: Camp registration is non-transferrable. For tutoring, hours are transferable to alternate tutors for alternate subjects as deemed necessary. Parents, guardians, and adult students can reserve hours or place tutoring on hold for alternate courses or transfer them to other family members (living in the same household).

HI IQ LEARNING’S EXCLUSIVE RIGHT TO TERMINATE: This agreement may be terminated at any time if, in HI IQ Leaning’s judgment, the service being conducted under circumstances not conducive to the student’s This includes, but is not limited to, abusive, hostile, or unsafe actions; unreasonable expectations placed upon the instructors and team members; and any attempts by the customer or student to compromise HI IQ Leaning’s integrity and safety. If HI IQ Learning terminates the enrollment all paid unused hours will be refunded to the client.
